G-TECH GENERAL TERMS AND CONDITIONS OF SALE (GTC) ONLINE
Version 2024-8; Published and applicable as of August 1, 2024.
These General Terms and Conditions of Sale determine the terms and conditions applicable to sales between individuals purchasing from the online stores of G-Tech:

The online stores are owned and operated by SAS G-TECH, registered in France under number 752 654 822 000 28 with the Grenoble Trade and Companies Register (RCS), with a capital of €472,564.98, and whose registered office is located at 85 rue Louis Baran in SAINT-JEAN-DE-MOIRANS (38430) and hereinafter referred to as "G-TECH", or "we" as the context requires.
For all sales made through the online stores, the parties to the sales contract communicate electronically (visiting the online stores, sending emails, or electronic submissions). They acknowledge that all contracts, notifications, communications of information, and other types of exchanges conducted electronically comply with legal provisions requiring such exchanges to be in writing.
The provisions of these General Terms and Conditions of Sale are not intended to (and should not be construed as) limiting any rights granted to you by law, rights which you cannot waive or limit by contract.
1. TERMS AND CONDITIONS OF APPLICATION
These General Terms and Conditions of Sale apply only to purchases made in the above-mentioned Online Stores. G-TECH reserves the right to modify these General Terms and Conditions of Sale at its discretion.
G-TECH undertakes to specify the effective date of the new General Terms and Conditions of Sale above. Any changes to these General Terms and Conditions of Sale will apply to orders placed from the effective date.
All information contained in G-TECH's advertising materials, brochures, and other written documents, accessible on G-TECH's websites or provided to you, constitutes solely an "invitation to enter into a business relationship/negotiation" and not a genuine offer from G-TECH to supply Products.
Any order for Products constitutes the buyer's unconditional acceptance of these General Terms and Conditions of Sale.
2. ORDERING PROCEDURE
To purchase the Products, you must meet the following conditions:
• provide your full name, exact address, telephone number, email address, bank details/payment information, and any other information required on the website when creating your account;
• be at least 18 years old;
• provide a delivery address (G-TECH may not be able to deliver the Products to certain addresses, including P.O. addresses, incomplete addresses, P.O. boxes, "mailboxes," overseas military addresses, hotels, hostels, and prisons);
• be the holder, or authorized user, of a valid credit/debit card if you are paying for the Products by credit/debit card.
To place an order, click on the "add to cart" link/button after selecting your Products, then complete the entire order by accessing the payment page.
The order will only be considered registered and will therefore only be processed after payment has been validated.
It is your responsibility to verify that your online payment has been completed correctly.
When creating your account, if you choose this option, you will also be asked to create a user ID and password. Please protect your password and do not disclose it to anyone, as you are personally responsible for any purchases made with your user ID and password.
3. VALIDATION OF YOUR ORDER AND FORMATION OF THE SALES CONTRACT
You acknowledge that your order constitutes an offer to purchase the Products listed therein, subject to these General Terms and Conditions of Sale.
All orders must be accepted by G-TECH, which reserves the right to reject orders deemed abnormal or made in bad faith.
After receiving your order, G-TECH will send you a confirmation email indicating your order number and details of the Products ordered.
Any order will only result in the formation of a valid sales contract with G-TECH when you receive a confirmation email for your G-TECH order.

4. PRICE, DISCOUNT, SHIPPING AND HANDLING, CHARGES, AND TAXES
The price charged for a Product will be the price in effect at the time of the order. It is indicated on the order receipt and in the order confirmation email. G-TECH may change the price of its Products at any time, at its discretion, and without prior notice. Price increases will only apply to orders placed after these changes have been made.
Product prices do not include shipping and handling charges but do include other applicable taxes.
Unless otherwise stated, the promotional codes and discounts indicated apply to shipments within Metropolitan France only.
Your G-TECH Order Confirmation email will detail the various charges applied (shipping, handling, applicable VAT, and other taxes).
5. PRODUCT AVAILABILITY AND DELIVERY, FORCE MAJEURE
G-TECH undertakes to provide you with a maximum delivery time, which may not exceed 30 days following the order, unless you expressly agree to a longer period.
If you unreasonably delay delivery or receipt of delivery after we have notified you that we have attempted to deliver the ordered Products, or if the delivery address you provided is incorrect and prevents us from completing delivery, the package will be returned to us. If the Products are not delivered within seven (7) working days of the first delivery attempt and are returned to us, we will consider that you have exercised your right to cancel the contract/withdrawal and, upon receipt of the undelivered package, we will refund you in accordance with our returns policy, less the shipping costs for the order and any additional return costs incurred by G-TECH.
G-TECH shall not be held liable in the event of force majeure, as defined by case law.

The table below provides a summary of delivery costs by carrier and delivery method chosen, as well as the estimated delivery times for each option:
6. CONFORMITY, PRODUCT INFORMATION
Each Product is described in a description stating its essential characteristics within the meaning of Article L.111-1 of the French Consumer Code. However, there may be minor differences between the photos, text, and drawings associated with the Products presented and the final Product delivered to the Customer.
When ordering, please verify that the purchased Product actually corresponds to your intended use; use the information available on the Online Store as the sole reference point to validate the Product's compatibility with your intended use.
In the event of a discrepancy between the information provided by the Online Store and that presented on a website other than G-TECH's (or any other source of information), the information on the G-TECH online store will be considered the sole reference regarding the use and purpose of the Product.
Upon delivery, G-TECH recommends that you examine the packaging and, if damaged, report any damage to the carrier. We also recommend that you check the products received within 7 (seven) days of receipt to ensure that the delivery is complete, consistent with the order, and that the Products are in good condition.
7. PAYMENT
Only payments with credit cards accepted by G-TECH will be authorized on the Online Store. Please refer to the list of authorized cards on the Online Store (in the "My Order" tab). You must provide your payment card information when placing your order. G-TECH will ship the ordered Products after your card's issuing bank authorizes its use for payment.
The invoice for your order constitutes proof of purchase. You can view and download all your invoices by accessing your account on

using the login details provided during your registration.
8. TRANSFER OF OWNERSHIP
G-TECH retains full ownership of the Products until it has received all amounts due for the Products ordered.
9. PRODUCT RETURNS AND REFUNDS, OTHER OPTIONS
If you purchased Products for your personal use as a consumer, you have the right to withdraw and return the purchased Products within 14 days of receiving them. If you wish to return a product, please refer to the returns procedure or follow the instructions on the return form received with your package.
After receiving and confirming the Products you wish to return, G-TECH will send you a return confirmation by email.
The refund for the Products will then be processed and confirmed by email. A full refund of the original price will then be issued within a maximum of 14 days following the return of the returned products.
When exercising your right of withdrawal, G-TECH also offers you two refund options of your choice.
Please note that you cannot exercise your right of withdrawal for contracts for the supply of goods made to the consumer's specifications or clearly personalized according to current legislation (Article 120-20-2 of the French Consumer Code).

10. PRODUCT RETURNS/HOW TO RETURN PRODUCTS?
Products must be returned by you and at your expense.
We encourage you to opt for tracked shipping or proof of receipt. In the event that your package is lost by the Post Office or any service provider to whom you have entrusted it, we will not be able to process your exchange or refund without proof of sending and, above all, proof of receipt.
You must include all accessories, user manuals, and any gifts delivered in the same packaging. All products must be returned in their original condition and packaging.
When a Product purchased is part of a bundle, all the Products in that bundle must be returned. We ask that you treat the Products with all due care and return them to us in the condition in which they were delivered. We recommend that you use the original packaging, if possible, or package them securely. Please ensure that the return code and your order number are clearly visible on the outside of the package.
To ensure the prompt and secure return of the Products, we recommend that you follow the return procedure and use the document provided by G-TECH for this purpose.
Any replacement or refund can only be processed once we have received all the Products to be returned.
In the event of a replacement, the original Products will be replaced with identical new Products.
If the return of the Products occurs under any of the conditions set out below, we reserve the right to refuse the returned Products and not issue any refund, or to deduct from the amounts to be reimbursed to you any reasonable repair costs or other similar direct costs incurred (subject to the provisions of applicable law):
1) you are not authorized to return the Products to us;
2) the Products are not in their original condition;
3) the Products are not packaged or have not been packaged properly;
4) some Products that have been delivered are not returned to us;
5) you have not followed the returns procedure; or
6) you have not taken the required precautions for the storage or return of the Products.
If the return of the Products is deemed acceptable, we will refund the price actually paid for the Products within 14 (fourteen) calendar days after dispatch (see conditions above), by crediting your payment card.
G-TECH will exclusively handle returns and refunds for products purchased from the Online Store.
11. PRODUCT WARRANTY AND LEGAL RIGHTS
The legal guarantee of conformity.
Guarantees the consumer against any operating defect arising, in particular, from a material, manufacturing, or design defect, under the conditions below. This warranty is valid for two years from delivery of the product, in accordance with Article L. 217-4 of the French Consumer Code.
If you believe you are entitled to benefit from this warranty, we invite you to complete the online after-sales service form, specifying in particular:
Product purchase date + proof
Product reference
Defect or problem encountered (excluding improper use of the product or accidental damage)
And, if possible, provide a photo of the product or defective parts.
We will then offer you a repair, replacement, or refund, as appropriate, in accordance with Article L. 211-9 of the French Consumer Code.
12. PERSONAL DATA
G-TECH's Privacy Policy and the additional terms and conditions contained in these General Terms and Conditions of Sale govern the use of your personal data. Purchasing Products from the online store implies that you accept the provisions of G-TECH's Privacy Policy.
13. G-TECH'S LIABILITY
These General Terms and Conditions of Sale define the scope of our obligations and liability regarding the supply of the Products. In particular, it is not our responsibility to verify that the Products are suitable for the purposes for which you intend them.
G-TECH shall not be held liable for the transmission of false information or for any modification of the product after delivery.
14. GENERAL PROVISIONS
If any provision of these General Terms and Conditions of Sale is declared invalid, unlawful, or inapplicable, that provision shall be applied to the strictest extent permitted by applicable law. The other provisions shall remain valid and fully applicable.

You can contact us by email or telephone from Monday afternoon to Friday (except public holidays), from 10:00 a.m. to 12:00 p.m. and from 2:00 p.m. to 4:00 p.m.
16. APPLICABLE LAW
These General Terms and Conditions of Sale are governed by and interpreted in accordance with French law.
